(IntegrityPress.org) – The Florida judge overseeing Jack Smith’s presidential records case against former President Donald Trump has thrown the case out as of Monday, July 15. Trump was accused of 37 individual allegations of wrongdoing under the indictment, he had pleaded not-guilty and the case was ongoing at the time it was dismissed.
Trump’s team moved to have the entire case dismissed over allegations that Attorney General Merrick Garland had illegally appointed Smith as special counsel. The act requires authorization from Congress which had expired and was not renewed at the time Garland appointed Smith to the task.
Judge Aileen Cannon agreed and dismissed the indictment entirely explaining that his appointment violated the Appointments Clause of the U.S. Constitution. Cannon was appointed by Trump during his first term and has largely been criticized as being the only district judge to give Trump favorable rulings in the corporate press.
In conversations with conservative media, Trump said that he was “thrilled” to hear the news. He cited wisdom and courage as major contributing factors to Cannon’s decision and suggested the decision has major implications for other cases against him to which Smith is attached.
The news came on the first day of the Republican National Convention in Milwaukee, invigorating attendees. Trump called the news “a big, big deal,” and added that it will energize the conference.
The Appointments Clause requires confirmation by the Senate for the appointment of a special counsel. The Biden administration has had no qualms skirting or ignoring the law entirely when it comes to issues like the southern border crisis or forgiving student loans. It’s unsurprising that the administration similarly ignored Constitutional requirements during the prosecution of its greatest potential threat. They clearly had no problem flouting centuries of established precedent.
Smith’s office may appeal the ruling, but without Senate confirmation the issue seems rather cut and dried.
