Levi had $37, panicked, and soon after died by suicide. Four months later in Dunblane, Scotland, 16-year-old Murray Dowey faced a similar Instagram-based sextortion scheme and also took his own life. Their families now argue this pattern is not random tragedy, but engineered vulnerability.

Their legal theory is simple and brutal: when a platform makes it easy for predators to find children, harm stops being a fluke and becomes a foreseeable outcome.
What Meta’s Own Files Allegedly Reveal
Unsealed internal Meta documents, cited by the Social Media Victims Law Center (SMVLC), reportedly show that as far back as 2019, Instagram was documenting large-scale, inappropriate interactions between adults and minors in direct messages. Researchers allegedly calculated that defaulting teen accounts to private could prevent 5.4 million unwanted DMs to minors every day.[1] According to the complaint, Meta leadership rejected that recommendation, worried it might slow youth growth and engagement on the platform.
From a common-sense, conservative perspective, this is where the story shifts from tech mishap to moral indictment. If those internal numbers hold up in court, they suggest a company that understood the risk profile down to daily message volumes and still chose the growth path. SMVLC founder Matthew Bergman characterizes Instagram as a “hunting ground for predators” and the “epicenter of sextortion-related youth suicides,” arguing these deaths were a foreseeable consequence of those product choices, not an unpredictable storm.
Corporate Responsibility Versus Criminal Blame
Meta publicly calls sextortion a “horrific crime,” stressing its cooperation with law enforcement and highlighting newer safeguards like default-private teen accounts and expanded parental controls. Those steps deserve acknowledgment. But the lawsuit presses a different question: did Meta move only after years of preventable damage, including Levi’s and Murray’s deaths?The families argue that criminals exploited design pathways Meta had already flagged internally—open discovery of teen accounts, visible follower lists, and unsolicited DMs from strangers.
American conservatives often emphasize personal responsibility and law-and-order, which naturally points first to the sextortionists themselves. No algorithm forced these criminals to target children. Yet when a platform knowingly leaves every digital door unlocked for minors and then markets that environment aggressively to teenagers, the analogy starts to resemble a landlord refusing to fix a broken lock in a high-crime neighborhood. The thugs still pull the trigger, but ignoring the lock begins to look less like naivety and more like negligence.
The New Battleground: Product Design as a Legal Duty
This case lands in a broader shift from debating “bad content” to scrutinizing “bad design.” SMVLC is pushing courts to treat recommendation systems, DM pathways, and default settings as products with foreseeable risks, not neutral pipelines for user speech. If a judge or jury accepts that logic, Meta’s exposure extends well beyond two heartbreaking suicides to a potential wave of claims focused on sextortion, grooming, and other child harms facilitated by design.
For parents, the implications are immediate. Levi’s mother has said she never imagined that complete strangers could message her young son so easily on Instagram. That assumption—that a kids-heavy app must come with kids-first guardrails—turns out to be dangerously optimistic. Whether or not the lawsuit succeeds, the unsealed material functions as a blunt warning label: when your child downloads a “free” app, the real currency may be their privacy, mental health, and, in the worst cases, their life.
